These Terms of Use set out the general rules of use applicable to all users (the “User”) who access and benefit from the www.dtex-tr.com website (the “Website”) operated by DTEX Savunma Madencilik Ticaret Limited Şirketi (“DTEX” or the “Company”). Every User who accesses the Website is deemed to have read, understood and accepted these Terms of Use, independently of the Membership Agreement.
ARTICLE 1 — PARTIES AND DEFINITIONS
1.1. Site Owner: DTEX Savunma Madencilik Ticaret Limited Şirketi — Folkart Towers Tower A, Floor: 26, No: 2601, Bayraklı / İZMİR. MERSIS: 0313149012000001.
1.2. Content Provider: Within the scope of Article 2/1-f of Law No. 5651, refers to natural or legal persons who produce, modify and provide any information or data offered to users via the internet. On the Website, DTEX acts in the capacity of content provider.
1.3. User / Visitor: Refers to any natural or legal person who accesses the Website through any device and connection, views its content or benefits from its services. Whether or not a membership registration exists does not affect the status of User.
1.4. Content: Refers to all text, images, video, audio, logos, designs, calculation algorithms, the legislation database, reports, blog posts, academic content and all other digital materials on the Website.
ARTICLE 2 — SCOPE AND VALIDITY OF THE TERMS OF USE
2.1. These Terms of Use apply to all Users who access and visit the Website and are applied independently of the Membership Agreement. For Users who register for membership, these Terms of Use apply without prejudice to the special provisions of the Membership Agreement.
2.2. Every User who enters the Website is deemed to have accepted these Terms of Use unconditionally. Users who do not accept the Terms should refrain from using the Website.
2.3. DTEX reserves the right to unilaterally amend these Terms of Use. Amendments enter into force on the date they are published on the Website.
ARTICLE 3 — FRAMEWORK OF THE WEBSITE SERVICES
3.1. The Website is a digital platform providing academic information, a legislation database, engineering calculation modules, training content, reports and decision-support tools in the fields of explosives engineering, mining and related technical areas.
3.2. The content and calculation tools provided on the Website have been prepared on the basis of academic literature and national and international engineering standards, and are intended for EDUCATIONAL, ACADEMIC and PRELIMINARY ANALYSIS PURPOSES. The professional review, authorisation and regulatory compliance processes required for field application are the responsibility of the User.
3.3. DTEX provides services of different scopes via the Website, both FREE OF CHARGE and PAID; the conditions of paid services are separately regulated by the Membership Agreement and the Distance Sales Agreement.
ARTICLE 4 — OBLIGATIONS OF THE USER
The User is obliged to comply with the following obligations when using the Website:
4.1. To use the Website in accordance with the laws of the Republic of Türkiye, morality and decency, rules of good faith, public order, personal rights and international agreements.
4.2. Not to engage in acts that obstruct, disrupt, slow down or manipulate the operation of the Website; not to research or exploit security vulnerabilities of the system.
4.3. Not to upload to the site or transmit through the site any content containing viruses, trojans, malware, spam or phishing.
4.4. To protect the confidentiality of Member Account username and password information; not to engage in unauthorised access, account sharing or account sale.
4.5. Not to disturb other Users for the purposes of harassment, threat, insult or defamation; to respect personal rights.
4.6. Not to use the Website without permission in a manner that infringes the intellectual/industrial property rights of others or for the purpose of obtaining commercial gain.
4.7. To assess the accuracy, currency and fitness for use of the Website content at their own responsibility; in particular, to pay attention to the limitation of liability in Article 6 for technical and calculation content.
4.8. To refrain from practices such as bulk/automated data extraction (web scraping, crawlers), reverse engineering, or copying content for the purpose of training artificial intelligence models.
ARTICLE 5 — PROHIBITED USES
The following acts are STRICTLY PROHIBITED on the Website:
- Sharing content contrary to the fundamental characteristics of the Republic of Türkiye, the constitutional order or public security
- Content containing terrorist propaganda, violence, hate speech, racism or discrimination
- Any content relating to the sexual abuse of children or obscenity
- Sharing information aimed at the unlawful production, sale or use of explosives or weapons
- Making requests for the supply of explosives, controlled chemicals or hazardous substances contrary to legislation
- Unauthorised collection, sharing or processing of third parties’ personal data
- Attacks on the technical infrastructure of the Website (DDoS, brute force, SQL injection, etc.)
- Creating fake accounts, impersonating identity information, acting on behalf of another person
- Sending advertisements, announcements, spam messages or chain e-mails (without the express permission of DTEX)
- Unauthorised copying, reproduction, creation of derivative works or commercial use of Website content
- Distributing malware, viruses, trojans or spyware
- Account sale, membership transfer or creation of multiple memberships
ARTICLE 6 — USE OF CALCULATION MODULES AND TECHNICAL CONTENT
6.1. The Calculation Modules on the Website (ANFO Stoichiometry, Decision Support, etc.) and technical content have been prepared on the basis of academic literature and engineering standards. However, the content is OF A GENERAL NATURE and FOR EDUCATIONAL PURPOSES; it has not been prepared for a specific site or project.
6.2. BEFORE transferring results obtained from the Calculation Modules to field application, the User is obliged to: (i) have them reviewed by an expert engineer authorised under Regulation No. 87/12028 and holding a Blaster Competence Certificate; (ii) verify their compliance with the relevant legislation such as Mining Law No. 3213, the Environmental Noise Control Regulation and the Waste Management Regulation; (iii) obtain the necessary administrative permits.
6.4. The User expressly acknowledges and declares that use of the Calculation Modules is at their own responsibility, and that they will assess the accuracy of the results through review by an engineer expert in the relevant field.
6.5. DTEX exercises reasonable care to keep the legislation database up to date; however, verification of the current and accurate state of the legislation from the official sources, the Official Gazette and mevzuat.gov.tr, is the responsibility of the User.
ARTICLE 7 — INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
7.1. The design, source code, images, logo, trade mark and trade name, content, calculation algorithms, databases, texts, audio, video and all other components of the Website belong to DTEX and/or its licensors within the framework of Law No. 5846 on Intellectual and Artistic Works, Industrial Property Law No. 6769 and the relevant legislation.
7.2. The User may not reproduce, distribute, offer for sale, use for commercial purposes, create derivative works from, transfer to other platforms, or make shares exceeding the quotation limit of, the content on the Website without the written permission of DTEX.
7.3. Limited quotation for academic purposes within the rules of scientific citation is permitted, provided that the source is cited. In such case, the citation must be made in the following format: “DTEX Savunma Madencilik, www.dtex-tr.com, [Date of Access]”.
7.4. In the event of infringement, DTEX reserves the right to exercise all its legal rights under Law No. 5846 and the relevant legislation. The User is obliged to compensate the damages arising from the infringement.
ARTICLE 8 — THIRD-PARTY LINKS AND CONTENT
8.1. The Website may contain links directing Users to third-party websites, academic sources, legislative texts or video platforms for information purposes.
8.2. DTEX assumes no responsibility whatsoever for the accuracy, security, legality or currency of the content of third-party websites. Access to third-party links is at the User’s own responsibility.
8.3. Third-party sites are subject to their own privacy policies and terms of use; DTEX’s texts do not apply to those sites.
ARTICLE 9 — COOKIES AND PROCESSING OF PERSONAL DATA
9.1. The Website uses cookies and similar technologies to improve the user experience, provide session management, and for analytics and marketing purposes. For detailed information on cookie use, the “Cookie Policy” on the Website should be reviewed.
9.2. The processing of the User’s personal data is carried out within the scope of Law No. 6698 (KVKK). For detailed information, the published KVKK Privacy Notice (www.dtex-tr.com/kvkk-aydinlatma-metni) and the Membership Process KVKK Privacy Notice should be consulted.
9.3. For processing activities requiring explicit consent, an Explicit Consent Declaration is separately issued and the User’s approval is obtained.
ARTICLE 10 — LIMITATION OF LIABILITY
10.1. DTEX exercises reasonable care to ensure the operation of the Website, to keep content up to date and to support the uninterrupted functioning of the technical infrastructure. However, DTEX cannot be held liable for the temporary unavailability of the Website due to internet infrastructure problems, server outages, cyber attacks, force majeure and other reasons.
10.2. DTEX does not undertake that the Website is suitable for the User’s specific needs, that it will operate without error or interruption, or that it will guarantee the desired results.
10.4. DTEX cannot in any way be held liable for indirect damages, loss of profit, damage to reputation, loss of data, claims of third parties or non-pecuniary damages.
10.5. These limitations of liability are valid without prejudice to the provisions of Article 115 of the Turkish Code of Obligations; cases of gross negligence and wilful misconduct are excluded.
ARTICLE 11 — OBLIGATIONS UNDER LAW NO. 5651
11.1. DTEX has the status of “content provider” under Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications, and complies with the obligations listed in Article 4 of the same law.
11.2. If content infringing the rights of third parties is detected on the Website by Users, notification may be made to DTEX, in its capacity as content provider, at info@dtex-tr.com. Upon notification, the relevant content is assessed within the scope of Articles 9 and 9/A of Law No. 5651; if the notification is found justified, the content is removed within 24 hours.
11.3. Traffic and access log records are retained for a minimum of 2 (two) years in accordance with Law No. 5651 and the relevant regulations.
ARTICLE 12 — CHANGES AND UPDATES
12.1. DTEX reserves the right to unilaterally change, add to or remove the design of the Website, its content, the services offered, its pricing and these Terms of Use.
12.2. Changes to these Terms of Use enter into force on the date they are published on the Website. The User’s continued use of the site after a change means that the User has impliedly accepted the changes.
12.3. Material changes to the Terms of Use are notified to Users with a membership registration at their registered e-mail address.
ARTICLE 13 — TERMINATION OF ACCESS
13.1. DTEX has the right to block, temporarily or permanently and without notice, the access to the Website of Users in respect of whom it detects acts contrary to these Terms of Use, legislation, morality or public order.
13.2. DTEX reserves the right to close to access or withdraw from publication all or part of the Website at any time and for any reason.
ARTICLE 14 — GOVERNING LAW AND COMPETENT COURT
14.1. These Terms of Use are subject to the law of the Republic of Türkiye.
14.2. In the resolution of disputes arising from the Terms of Use, where the User has consumer status, the Consumer Arbitration Committees and Consumer Courts within the framework of Law No. 6502 are competent.
14.3. In disputes with legal-entity Users, the İzmir Courts and İzmir Enforcement Offices are competent.
ARTICLE 15 — MISCELLANEOUS PROVISIONS
15.1. These Terms of Use enter into force on the date they are published on the Website and remain in force unless amended.
15.2. The invalidity or unenforceability of any provision of the Terms of Use does not affect the validity of the other provisions.
15.3. DTEX’s failure to exercise its rights arising from the Terms of Use in due time does not mean that it has waived those rights.
15.4. The Terms of Use are assessed as a whole together with the Membership Agreement, the Distance Sales Agreement, the KVKK Privacy Notice, the Cookie Policy and other policy documents published on the Website. In the event of conflict, the special provision prevails over the general provision.
